Terms of Use

By downloading or using the Shade iOS application ("Shade"), you agree to these Terms of Use. If you do not agree, do not use Shade.
1. Apple-licensed application
Shade is licensed to you under Apple's Standard End User License Agreement (EULA), with the additional terms below. Where the Apple EULA conflicts with these Terms, these Terms govern.
2. Eligibility
You must be at least 13 years old to use Shade. If you are under the age of majority in your jurisdiction, you may use Shade only with the consent and supervision of a parent or legal guardian.
3. Cosmetic tool, not a medical device
Shade is a cosmetic tracking tool. Tooth shade detection uses the Vita Classical 16-shade reference scale and is provided for personal interest only. Shade does not diagnose, treat, cure, or prevent any disease, condition, or oral-health problem. Shade is not a substitute for professional dental advice, examination, diagnosis, or treatment. Always seek the advice of a qualified dentist with any questions you may have about your oral health.
4. Subscriptions
Shade offers an auto-renewable subscription, "Shade Premium":
- Annual plan with a 3-day free trial, then a yearly charge at the price displayed in the app at the time of purchase.
- Monthly plan billed monthly at the price displayed in the app at the time of purchase.
Payment is charged to your Apple ID account at the confirmation of purchase. Your subscription automatically renews at the end of each billing period at the same price unless you cancel at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your Apple ID settings: Settings → [your name] → Subscriptions, or at apps.apple.com/account/subscriptions.
If you cancel during a free trial, you will not be charged. If you cancel after a paid period has begun, you keep access until the end of that period; refunds are handled by Apple at Apple's discretion.
5. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of Shade, except to the extent permitted by applicable law.
- Use Shade to violate any law or any third party's rights.
- Attempt to gain unauthorized access to other users' accounts or to Shade's backend infrastructure.
- Submit content (including photos) that you do not have the right to submit.
6. Your content
You retain ownership of the photos and content you submit to Shade. You grant Shade a limited, non-exclusive license to store, display, and process that content solely to operate the app for you (e.g., to show you your photo history). We do not use your content for marketing, advertising, or AI training. See the Privacy Policy for details on data handling.
7. Intellectual property
Shade — including its design, code, copy, and brand — is the property of Hakan Tunç (the developer) and is protected by intellectual-property laws. The Apple Standard EULA grants you a personal, limited, non-transferable license to use Shade.
8. Disclaimer of warranties
Shade is provided "as is" and "as available," without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that Shade will be uninterrupted, error-free, accurate, or free of viruses, or that the shade analysis will match clinical measurement.
9. Limitation of liability
To the maximum extent permitted by law, Shade and its developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or profits, arising out of or in connection with your use of Shade.
10. Termination
You can stop using Shade and delete your account at any time from inside the app. We may suspend or terminate your access if you violate these Terms.
11. Changes to these Terms
We may update these Terms as Shade evolves. Material changes will be reflected in the "Last updated" date above. Continued use of Shade after an update means you accept the revised Terms.
12. Governing law
These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-laws principles. The Apple EULA's choice-of-law and dispute-resolution provisions also apply where relevant.
